STMicroelectronics FlexWare Tools License

NOTICE TO USER: BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This STMicroelectronics Flexware Tools End User License Agreement accompanies STMicroelectronics Embeded System Technology products and related explanatory materials ("Software"). The term "Software" also shall include any upgrade, modified version or update of the Software provided to you. This license agreement applies to all Flexware software, unless a product includes its own license agreement.
Please read this Agreement carefully and agree to all terms before using this software. Unless you have a different license agreement signed with STMicroelectronics company your use of this software indicates your acceptance of this license agreement and warranty.

1. Use of the Software.

You may install the Software on a hard disk or other storage device. A registered copy of the Software must be used by a single person who uses the software personally on one or more computers. You may access the Software through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if 8 different workstations will access the Software on the network, each workstation must have its own Software license, regardless of whether they use it at different times or concurrently.

2. Copyright and Trademark Rights.

The Software is owned by STMicroelectronics and its suppliers, and its structure, organization and code are the valuable trade secrets of STMicroelectronics and its suppliers. This Agreement does not grant you any intellectual property rights in the Software.

3. Restrictions.

You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software; redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer rights to the Product; publish any results of benchmark tests run on the Product to a third party without STMicroelectronics's prior written consent.

4. No Warranty.

The Software and the accompanying files are being delivered to you "AS IS" and STMicroelectronics makes no warranty as to its use or performance.

STMICROELECTRONICS AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE OR DOCUMENTATION. STMICROELECTRONICS AND ITS SUPPLIERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL STMICROELECTRONICS OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF AN STMICROELECTRONICS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.

Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT.
